Domestic violence is a serious offense prosecuted in specialized domestic violence courts.
The charges arise out of violence or abuse between family members, spouses or ex-spouses, or people who live together.
Because of the heightened attention that domestic violence cases receive, these cases are aggressively investigated and prosecuted by law enforcement, which has the explicit authority to make an arrest for this type of criminal offense, without an arrest warrant, as long as probable cause is established.
A defendant arrested for domestic violence will not be able to post a bond until appearing before a magistrate, often resulting in high bonds, severe conditions of release or no bond at all.
